Apple's busted in Brazil (again) for not including iPhone chargers

From Matthew Loh's "Apple must pay a man more than $1,000 for not including a power adapter with his new iPhone, judge rules" posted Thursday on Insider:

A Brazilian judge has ordered Apple to pay 5,000 Brazilian reals, or $1,081, to a man for not including a power adapter with the sale of his new iPhone.

Judge Vanderlei Caires Pinheiro of a civil court in the city of Goiânia ruled the practice a "tie sale," or a situation in which a company requires that a customer buy two of its products for one of them to work, according to court documents seen by Insider.

The judge said Apple had "obliged the consumer to purchase a second product of its exclusive manufacture," calling it an "abusive and illegal commercial practice."

In its defense, Apple said each iPhone came with a USB-Cto Lightning cable, which lets consumers charge their phones using power adapters they can buy from other companies, according to the court documents.

But the judge rejected the argument, saying the cable didn't work with wall adapters lacking a USB-C port, with which the Apple charger was designed.

Apple first announced it would stop providing power adapters with its iPhone 12 in 2020, which the Brazilian government said it found to be abusive. In 2021, it fined Apple $2 million for the practice, saying the tech giant failed to demonstrate the "environmental gain" it had advertised, according to the Brazilian outlet G1.

My take: The Brazilian courts have a point, but $1,081 per customer could really add up.

    Easy fix…buy one (the iPhone), get one free (the adapter) after raising the price on the iPhone. Then provide a credit for anyone who doesn’t need/take the adapter. It is all recorded/documented right there on the receipt. We all know that lotsa’ folks have lotsa’ random and sometimes useless adapters floating around the house that we don’t need anymore, but that ‘out of sight, out of mind’ means we don’t prioritize getting them recycled. Even Apple adapters.

    Agree. Add the charger cost as part of the iPhone sale and if they do not want, rebate the $$$. Simple. Either way this is ridiculous on many levels.

    1) No charger has been a plainly stated up front disclosure
    2) A charger costs a fraction of that amount
    3) They are a million cheap third party chargers if needed

    How do these lawsuits pass the stupid test?

  3. Brazil’s government & courts continue to demonstrate how clueless the nation is regarding the environment, while the Amazon rainforest burns.
    I celebrated Earth Day today by planting a tree (2) and clearing trash from wetlands. I’ll visit some nearby hives but that’s business as usual for me. Sold 100 lbs of honey in one day yesterday, a recent personal record. In Puerto Rico I often sold barrels of coffee, wildflower or citrus honey.

    It is interesting to extend this logic to other products. Just for grins! As an example. Do they require lamps to be sold with light bulbs included? What about lamps which have to be installed and wired to internal house wiring? And yes some lamps now come with bulbs which cannot be replaced so are those going to be considered illegal?
    Can you buy a hammer without nails? Paint without brushes? Sheets without a bed? A car without gas? Or an electric car without a charger? Some countries regulate how certain items can be sold. Does Brazil say Apple can sell Iphones without chargers? I seem to recall at least on other country saying Apple had to include a charger. And if this is the law in Brazil Apple should make available a charger for anyone who purchased an Iphone without much quibble.

    One solution would be to have an option to select a free charger at check out. Put it up front, so that everyone that needs one will get one the same day the iPhone arrives. Those who don’t want or need can can receive a Apple gift card equal to the amount of a charger.
