Breaking: The DOJ has caved. Apple hearing is off

Reuters and CNBC are reporting that the FBI moved Monday to vacate Tuesday’s court hearing with Apple after a third party “demonstrated an alternate method” for unlocking the iPhone used by a San Bernardino shooter.

Nate Cardozo at the EFF tweeted what looks like an excerpt from the document:


This is an unexpected twist. Face saving? The hand of the NSA?

    How “convenient” Apple probably doesn’t have the right to demand the hearing continue to provide a declaratory judgement that would prevent FBI from changing its mind later (but IANAL!)

    Seems like this is first the hand of the White House. The President came out sounding reasonable and balanced. So neither he or Hillary or the Democrats can be tarred with being pro terrorism. Then they reined in the law enforcement (and maybe anti-Apple) fanatics at Justice. Pretty crafty, for a change. And, yes NSA is a likely “third party”.
